Legal Challenge Against Armed ICE Agents at Polling Sites Ahead of Midterm Elections
A group of advocacy organizations and a Democratic-led city have filed a lawsuit to prevent the Trump administration from sending armed Immigration and Customs Enforcement (ICE) agents to polling sites before the midterm elections in November. The lawsuit, filed in federal court in Washington, D.C., aims to stop any plans to have armed agents at polling places and to prohibit federal officers from carrying weapons near voting locations or places where votes are collected. The lawsuit argues that the presence of armed officers at polling sites could intimidate voters and threaten the freedom of the election.
The lawsuit specifically names the Department of Homeland Security and ICE, along with their leaders, as defendants. It was filed by the legal group Democracy Forward on behalf of several organizations, including the League of United Latin American Citizens, Common Cause, UnidosUS, and the city of Denver. The lawsuit cites a federal law that prohibits the deployment of armed troops or men to places where elections are held, unless necessary to repel armed enemies of the United States.
While some supporters of the Trump administration have called for ICE to be present at polling sites, officials have not confirmed concrete plans for such deployments. DHS Secretary Markwayne Mullin stated that ICE is not meant to patrol polling places but could be present if there is a threat or if agents are serving a warrant for someone they are actively pursuing. ICE's deportation branch focuses on enforcing immigration laws, while its Homeland Security Investigations branch has been increasingly involved in immigration enforcement and investigations related to voter fraud.
Despite speculation, the chairman of the Joint Chiefs of Staff, Gen. Dan Caine, has stated that the military has no intentions of sending troops or National Guard soldiers to polling places. The lawsuit seeks to ensure that voters can cast their ballots without fear of armed federal law enforcement presence, protecting the integrity of the election process.
