The Equal Employment Opportunity Commission (EEOC) has decided to drop its subpoena enforcement action against Nike after the company complied with requests for information related to an investigation into its diversity and inclusion policies. The EEOC filed a motion to dismiss the action in Missouri federal court, stating that Nike had provided the necessary information and documents, resolving the issue.
Nike, a major target of the EEOC's campaign against corporate diversity and inclusion policies, was under scrutiny for allegedly discriminating against white employees. The investigation was initiated by EEOC Chair Andrea Lucas based on a complaint she filed in May 2024. Nike's efforts to promote diversity, mentorship programs, and leadership representation were among the factors examined during the investigation.
The subpoena enforcement action shed light on the EEOC's investigation process, revealing that the agency sought data on Nike's employment decisions, criteria for layoffs, tracking of worker race and ethnicity data, and programs offering race-restricted mentoring and career development opportunities.
