Challenging Conviction: Mackenzie Shirilla's Legal Battle for Justice

Mackenzie Shirilla, who was convicted of a double murder, has filed a motion with the Ohio Supreme Court to reconsider hearing her appeals. Her attorneys argue that she faced confusing and inconsistent deadlines in her post-conviction challenges. Shirilla was convicted in 2023 of murdering her boyfriend and their friend, and was sentenced to life in prison with parole eligibility after 15 years served. Prosecutors claimed the crash was intentional based on evidence such as surveillance video and vehicle data showing the car was speeding without braking.

Shirilla's lawyers missed the deadline to file a post-conviction challenge by one day due to a calendar mistake, as they did not account for 2024 being a leap year. The Ohio Supreme Court affirmed the trial court's decision that it lacked jurisdiction to consider the petition. Prosecutors argued that Shirilla's deadline to challenge her conviction started on Oct. 23, 2023, and her attorneys filed late on Oct. 24, 2024.

Shirilla's new attorneys filed another appeal with the Ohio Supreme Court, arguing that the clock should have started later due to a separate transcript being filed weeks after the main trial record. They also claim that Shirilla would have been acquitted if she had received effective assistance of counsel. However, the Ohio Supreme Court's June decision upheld the trial court's ruling on jurisdiction and stated that the arguments by Shirilla's lawyers did not meet exceptions.

Justice R. Patrick DeWine dissented from the decision, but the Ohio Supreme Court maintained that the trial court did not have the authority to excuse the delay in filing the post-conviction challenge. Shirilla's first parole hearing is scheduled for 2037.

In conclusion, Mackenzie Shirilla's legal team is continuing to pursue avenues to challenge her conviction for double murder, citing issues with deadlines and jurisdiction in the appeals process. Despite facing setbacks in the Ohio Supreme Court, they are determined to seek justice for Shirilla.
