Federal Judge Upholds Protest Group's Right to Display '8647' Flag: A Victory for Free Speech and Political Expression

A federal judge has made a ruling allowing a pro-impeachment protest group, Accountability NOW USA, to continue displaying a flag with the phrase "8647," which President Donald Trump interpreted as a death threat against him. The group has been demonstrating outside a federal courthouse calling for Trump's impeachment. Trump linked the phrase to former FBI Director James Comey and suggested a prison sentence for the act. However, the judge, U.S. District Judge Randolph Moss, determined that the phrase was not inherently dangerous and was used in the context of a demonstration focused on the constitutional impeachment and removal of the President.

The National Park Service had initially ordered the flag's removal, citing a law against threatening the president, and even had Secret Service agents read a volunteer her Miranda rights. However, Judge Moss dismissed the government's claims, stating that the term "86" is commonly used to mean "throw out" rather than "kill," and the group's signs, including one accusing Trump of raping minors, were protected political speech and not considered obscene.

The judge's ruling permanently prevents the National Park Service from taking action against the group's permit or confiscating their signs and flags based on the phrase "8647." The decision clarified that the use of the phrase in the context of the protest did not constitute a threat against the President and upheld the group's right to engage in protected political speech.
