Three Wisconsin dairy farmers, in collaboration with a conservative legal organization, have initiated legal action against the federal dairy checkoff program, which supports promotional initiatives such as the well-known “Got Milk?” campaign. The lawsuit, filed by the Wisconsin Institute for Law & Liberty, targets U.S. Secretary of Agriculture Brooke Rollins and the National Dairy Promotion and Research Board. Established by the U.S. Department of Agriculture in 1983, the dairy checkoff mandates that American dairy farmers contribute a fee based on their milk production to finance marketing and research endeavors within the industry at both state and national levels, with Dairy Farmers of Wisconsin being a beneficiary of these funds. Similar checkoff programs are in place for various agricultural sectors like beef, pork, eggs, and potatoes. The lawsuit contends that the dairy checkoff program is a burdensome federal initiative that undermines small farms under the pretext of environmental sustainability, citing the checkoff-funded Innovation Center for Dairy Research as an example. This Center, governed by prominent dairy industry executives, emphasizes environmental stewardship as a key objective, setting goals such as achieving greenhouse gas neutrality by 2050 and enhancing water quality through optimized manure management. The lawsuit argues that the Center's emphasis on reducing greenhouse gas emissions does not align with the dairy checkoff program's core mission of promoting and marketing dairy products, and may even contradict these interests by implying that the dairy industry is environmentally harmful. The legal action aims to prevent future checkoff funds from supporting the Innovation Center's activities. Representatives from Dairy Management Inc., responsible for managing national checkoff funds, and Dairy Farmers of Wisconsin have not yet provided a response to inquiries from WPR.
