Judge Denies New Trial Request for Jose Ibarra in Laken Riley Murder Case

A judge has denied a request for a new trial for Jose Ibarra, a Venezuelan man convicted of killing Georgia nursing student Laken Riley. The case sparked national debate over immigration issues. Ibarra's lawyers argued that his constitutional rights were violated when the judge declined their motions before the trial. The judge found the evidence of Ibarra's guilt to be overwhelming and powerful, leading to his conviction and life sentence.

Jose Ibarra, 28, entered the U.S. illegally in 2022 and was allowed to stay while pursuing his immigration case. Prosecutors claimed that Ibarra encountered Riley while she was running on the University of Georgia campus and killed her during a struggle. Riley was a student at Augusta University College of Nursing in Athens, Georgia.

During the trial, Ibarra's attorneys requested a delay to allow an expert witness to review DNA evidence analyzed using TrueAllele Casework software. The judge determined that the denial of the delay did not harm Ibarra's case. Additionally, Ibarra's lawyers challenged the seizure of cellphones from his apartment, but the judge ruled that there were exigent circumstances justifying the seizure.

Attorneys for Ibarra have not yet commented on the judge's decision to deny a new trial. Ibarra has 30 days to file an appeal if he chooses to do so. The judge's order emphasized the strength of the evidence presented by the state during the trial, leading to Ibarra's conviction and sentencing.
