Blue Cross Blue Shield Antitrust Settlement: $2.67 Billion Agreement Reached

A significant class-action agreement has been reached in a lawsuit against Blue Cross Blue Shield Association, with a total settlement amount of $2.67 billion. The lawsuit alleged that Blue Cross Blue Shield companies engaged in anticompetitive practices that led to higher insurance costs for consumers. Despite denying any wrongdoing, the insurers agreed to the settlement to avoid prolonged legal proceedings. The settlement was approved by a federal judge in Alabama in October 2020.

Eligible claimants who filed valid claims before the November 2021 deadline can expect to receive settlement payments starting in May. Approximately $1.9 billion of the settlement fund will be distributed to subscribers after deducting legal fees and expenses. The individual payout amounts will vary based on the premiums paid and the type of coverage. While about 6 million claims were submitted nationwide, most individuals are likely to receive modest payouts.

The settlement covers individuals who were covered by a Blue Cross Blue Shield plan between February 2008 and October 2020. Claimants had until November 5, 2021, to submit their claims, while providers have until July 29, 2025, to do so. The settlement administrator began sending out claim notices to eligible class members on February 16. In addition to the monetary settlement, Blue Cross Blue Shield agreed to implement operational changes to promote market competition.

This lawsuit resulted in one of the largest antitrust settlements in the U.S. healthcare industry. The agreement aims to address the alleged anticompetitive behavior of Blue Cross Blue Shield companies and provide compensation to affected individuals. The settlement payments are a significant step towards resolving the antitrust claims and ensuring fair competition in the health insurance market.
