Fulton County, Georgia, to Challenge FBI's Seizure of 2020 Election Records in Federal Court

Fulton County, Georgia, is planning to file a lawsuit challenging the FBI's search and seizure of 2020 election records. Commissioner Marvin Arrington Jr. announced the county's intention to contest the legality of the warrant and the seizure of sensitive election materials. The lawsuit is expected to be filed in federal court in the Northern District of Georgia to address the actions taken by the Trump administration's Justice Department and the FBI.
Last Wednesday, the FBI executed a warrant at the Fulton County election office, seizing 700 boxes of election materials as part of an investigation into alleged voter fraud in the 2020 presidential election. Commissioner Arrington expressed concerns about the search warrant and emphasized the need to protect voter information. He highlighted the importance of limiting the scope of the warrant and ensuring that the documents remain in Georgia under seal.
While the FBI had authorization to copy the records pursuant to a court order, Arrington believes that the agency overstepped by taking physical custody of the original 2020 ballots and voter rolls. He raised issues regarding the lack of a chain-of-custody inventory at the time of seizure, making it difficult to verify the return of all materials. The FBI has not yet responded to inquiries about Fulton County's planned lawsuit.
An FBI spokesperson indicated that the seized materials would be transported to the FBI Central Records Complex in Virginia. The situation is still unfolding, and updates will be provided as more information becomes available.
