Former special counsel Jack Smith is set to testify before the House Judiciary Committee next week, allowing both Republican and Democratic lawmakers to question him publicly about his investigations into President Donald Trump. Smith will appear before the committee on January 22, following his previous closed-door deposition where he testified for eight hours about his special counsel work. Chairman Jim Jordan had initially demanded the deposition but also indicated the possibility of an open hearing.

During his tenure as special counsel, Smith investigated Trump and brought two indictments against him related to the 2020 election and the alleged retention of classified documents. Trump pleaded not guilty and contested the charges, leading Smith to drop both cases after Trump's reelection in 2024 due to a Department of Justice policy against prosecuting sitting presidents. In the upcoming public hearing, House lawmakers will have the opportunity to question Smith in five-minute increments, a departure from the one-hour sessions during the deposition.

Smith's initial meeting with the committee did not reveal much new information, as he defended his investigative decisions. He emphasized that his actions were based on facts and the law, without consideration for Trump's political affiliations or activities. Smith also defended the controversial decision to subpoena phone records of Republican senators and House members, stating that the subpoenas were in line with DOJ policy and aimed at a specific set of data. The Republicans have criticized the subpoenas as unconstitutional violations, alleging politicized criminal charges by the Biden DOJ against Trump.

Despite Trump's criticism of Smith, referring to him as a "thug," the former president has expressed readiness for Smith's testimony in a public hearing. Smith's lawyer, Lanny Breuer, reiterated Smith's willingness to address questions in a public setting regarding his investigations into Trump's alleged election interference and mishandling of classified information. The upcoming hearing will provide a platform for lawmakers to further scrutinize Smith's actions and decisions during his tenure as special counsel.
