Unsealed Court Order Reveals Controversy in Kilmar Abrego Garcia's Criminal Case

A recent court order in the criminal case against Kilmar Abrego Garcia has been unsealed, revealing that high-ranking Justice Department officials pushed for his indictment as a "top priority" after he was mistakenly deported and then ordered back to the U.S. Abrego Garcia, who faces charges of human smuggling in federal court in Tennessee, has pleaded not guilty and is arguing that the prosecution is vindictive. He claims that the government is seeking to punish him for the embarrassment caused by his erroneous deportation. U.S. District Judge Waverly Crenshaw's order, filed on December 3 and unsealed on Tuesday, sheds new light on the case.
Crenshaw had previously found that there was potential evidence of vindictiveness in the prosecution of Abrego Garcia. Rob McGuire, the former Acting U.S. Attorney for the Middle District of Tennessee, argued that Blanche's statements were irrelevant, as he alone made the decision to prosecute and harbored no ill will towards Abrego Garcia.

He contends that the government's actions are retaliatory and politically motivated.
