Texas Attorney General Files Lawsuit Against Xcel Energy for Smokehouse Creek Fire: Latest Updates and Developments

A lawsuit has been filed by Texas Attorney General Ken Paxton against Southwestern Public Service Company, operating as Xcel Energy, for their alleged involvement in causing the Smokehouse Creek Fire in 2024. This legal action follows an investigation initiated by Paxton in August into utility companies linked to the Smokehouse Creek and Windy Deuce fires in the Texas Panhandle in 2024. Xcel Energy has stated that they will cooperate with the Attorney General's office to understand the causes of the wildfires and have been actively engaged in addressing the issues surrounding the fires from the previous year.
Xcel Energy has conducted its own review of the fires and disputes claims of negligence in maintaining and operating its infrastructure. The company has been compensating individuals impacted by the Smokehouse Creek fire and has resolved a significant number of claims through a voluntary process. As of August, Xcel Energy has committed to substantial settlement agreements and payments to claimants. Investigations have indicated that the Smokehouse Creek Fire was initiated by a power line owned by utility companies, including Xcel Energy, Southwestern Public Service Company, and Osmose Utilities Services.
Attorney General Paxton has accused Xcel Energy of negligence that resulted in the loss of lives and extensive damage in the Texas Panhandle. The lawsuit seeks to recover economic damages suffered by the State, including property damage, loss of wildlife and habitat value, and civil penalties for violations of Texas law. The state is also seeking corrective action from Xcel Energy to address the issues raised in the lawsuit.
