Former special counsel Jack Smith's legal team has acknowledged that media reports played a significant role in his decision to subpoena the phone records of nine Republican lawmakers in 2023. This revelation has sparked further criticism from the GOP, who accuse Smith of political targeting. Smith's attorneys, Lanny Breuer and Peter Koski, defended the subpoenas as lawful and consistent with Department of Justice policy in a letter to Senate Judiciary Committee Chairman Chuck Grassley.

The subpoenas were issued in response to reports from various news outlets suggesting that President Donald Trump and his attorney Rudy Giuliani had attempted to contact senators during the Jan. 6 Capitol riot to influence the certification of the 2020 election results. The toll data collected only included information on the date, time, and duration of calls, not their content. Smith's lawyers emphasized that the data collection was limited to a specific timeframe to verify the media accounts.

Breuer and Koski refuted claims that Smith concealed the records and stated that his office followed DOJ procedures and obtained authorization from the Public Integrity Section before proceeding with the subpoenas. They highlighted that collecting telephone metadata is a routine investigative step used in both Democratic and Republican administrations. The letter from Smith's legal team marks his first direct response to allegations of targeting Republican members of Congress.

House Judiciary Committee Republicans are pushing for Smith to testify about what they perceive as politically motivated prosecutions. The committee has already interviewed other prosecutors involved in investigations of Trump during his time out of office. Chairman Jim Jordan expressed frustration with the lack of cooperation from witnesses and Smith's failure to respond to requests for document turnover. The ongoing scrutiny of Smith's actions underscores the contentious nature of the investigations into Trump and his associates.
