California Governor Signs AB 564: Reversing Tax Hike to Boost Legal Cannabis Industry

California Governor Gavin Newsom recently signed AB 564, a bill aimed at reversing a planned tax increase on the state's legal cannabis industry. The bill not only cancels the 25% tax hike but also establishes a fixed cannabis excise tax rate of 15% until 2028. This move is intended to support the growth of the legal market, ensure consumer access to safe products, and benefit local communities.

In addition to the tax relief, Governor Newsom's administration has ramped up enforcement efforts against illegal cannabis operators. The Unified Cannabis Enforcement Taskforce (UCETF) has confiscated and destroyed over 317 tons of illegal cannabis since 2022, signaling a crackdown on illicit activities in the industry.

Assemblymember Matt Haney, the author of AB 564, highlighted the struggles faced by licensed cannabis businesses in California. He emphasized the importance of providing a level playing field for legal operators to compete against the unregulated illegal market. Haney warned that the proposed tax increase could have pushed many small cannabis businesses to the brink of closure, driving consumers towards illicit sources.

The signing of AB 564 represents a significant step towards supporting the legal cannabis industry in California. By reversing the tax increase and implementing a stable tax rate, the state aims to foster the growth of the market, protect consumers, and promote the success of licensed businesses. This legislative action underscores the commitment to creating a thriving and sustainable cannabis industry in California.
