Portland Accuses ICE Facility of Land-Use Violations: Investigation Underway

The city of Portland has accused the U.S. Immigration and Customs Enforcement (ICE) facility on South Macadam Avenue of violating multiple land-use conditions. A violation notice will be sent to the facility this week. The facility has been operating under a conditional land use approval since 2011, but the city claims that it has breached several policies, including detaining individuals overnight or for more than 12 hours. The most recent violation was reported on May 20. Another alleged violation involves boarded windows at the facility, although specific details were not provided. An investigation was initiated by the city's permitting bureau in response to formal complaints, examining data obtained through the Freedom of Information Act (FOIA) from the nonprofit Deportation Data Project. The violation notice will kick off a process to assess whether the facility's detention practices align with its land use approval conditions. The facility can continue to operate during the investigation. If the violations are not corrected within 30 days, fines may be imposed, and a hearing may be scheduled by Portland Permitting and Development to reconsider the land use approval. The decision made during the hearing can be appealed to the Portland City Council. Portland Mayor Keith Wilson expressed disappointment in ICE for allegedly breaching detention limitations and commended the city's team for conducting a thorough investigation and taking the necessary steps in the violation process. The ICE facility in Southwest Portland has been a focal point of protests and community concerns, with residents raising issues about noise, tear gas, and pepper balls. A charter school relocated due to safety concerns related to chemicals and munitions used in the area. The Trump administration has threatened to deploy National Guard troops in Portland, a sanctuary city, to address crime issues. In August, residents urged the city to close the facility, prompting officials to consider potential code violations at the site.
