America First Legal Files Lawsuit Against FDA Over Puberty Blocker Guidance: Uncovering Risks for Children

America First Legal (AFL) has filed a lawsuit against the Food and Drug Administration (FDA) to access records related to the government's guidance on the use of puberty blockers for children. The group previously obtained communications from the Trump administration through a Freedom of Information Act (FOIA) request, revealing that the FDA was aware of the mental health risks associated with these drugs but still recommended their approval for children.
Despite acknowledging AFL's FOIA request for documents on the FDA's internal guidance regarding off-label use of puberty blockers, the FDA has not cooperated, and the deadline for document production has passed. AFL's counsel, Will Scolinos, emphasized the need to expose what officials knew about the administration's push for gender-denying treatments on American children.
AFL had to resort to litigation to compel the release of the initial set of documents, which eventually revealed that the Biden-era FDA Division of General Endocrinology recommended approving puberty blockers for children despite knowing the negative impacts, such as increased depression, suicidality, and seizure risks. Studies have also confirmed these risks associated with the use of puberty blockers.
Research conducted at the University of Texas on patients with gender dysphoria, including those who underwent gender surgery, highlighted the necessity of gender-sensitive mental health support to address post-surgical psychological risks. The study showed higher rates of depression and anxiety among individuals who underwent gender surgery compared to those who did not.
