Hotel Guests Awarded $1 Million in Lawsuit Over Bed Bug Bites: The Shores Inn Case Study

Staying at a hotel and ending up with bed bug bites is a nightmare scenario for many people. Two men from California, Alvaro Gutierrez and Ramiro Sanchez, experienced this firsthand during their stay at The Shores Inn in Ventura in February 2020. They filed a lawsuit against the hotel, claiming they suffered painful bed bug bites, skin rashes, allergic reactions, scarring, and other injuries all over their bodies. The lawsuit, filed in December 2021 by lawyer Brian J. Virag of My Bed Bug Lawyer, Inc., alleged that the hotel had a history of bed bug infestations, as indicated by previous guest reviews on Google and Yelp.
Upon checking into their room, Gutierrez and Sanchez discovered the bed bug infestation and were moved to another room, where they continued to be bitten by bed bugs. The lawsuit stated that the men had to seek medical treatment due to the bed bug bites, which caused them pain, illness, and emotional distress. Despite having reservations for a week-long stay, they left the hotel after just one night because of the bed bug infestation.
In May 2023, a jury awarded Gutierrez $400,000 and Sanchez $600,000 for pain, disfigurement, grief, and emotional distress caused by the bed bug bites. Additionally, each man received $500,000 in punitive damages. The hotel plans to challenge the decision, with appellant lawyer Wendy Lascher stating that they intend to appeal. The hotel's response to the verdict was not immediately available for comment.
The case highlighted the serious consequences of bed bug infestations in hotels and the impact they can have on guests' physical and emotional well-being. The lawsuit brought attention to the importance of maintaining proper hygiene and pest control measures in hospitality establishments to ensure the safety and comfort of guests.
